General Terms. Doggone Groomers & Boarding, having received at the time and place shown above, the above described pet for the purpose of boarding and any other service now or hereafter to be ordered by owner or owner's agent, at the expense of and for the account of owner, and owner understands that Doggone Groomers & Boarding will not allow any pet to leave Doggone Groomers & Boarding's premises on any given day later than 10:00 A.M., without charging one full day's board for boarding the pet. Owner shall pay all costs and charges of and for special services listed above, and all veterinary and medical costs that may be incurred hereafter for the pet pursuant to this agreement. Owner certifies to the correctness of the information here above given respecting the pet, and specifically agrees to be bound by the terms and conditions of this agreement.
Ownership. Owner specifically represents that he is the owner of the pet and that there is not now any lien or other encumbrance against the pet and that the pet has not been exposed to rabies or distemper within the last 30 days.
Illness. In the event the pet becomes ill, you will be notified at once at the address listed above. If you do not immediately inform Doggone Groomers & Boarding regarding measures to be taken or if the pet's health requires emergency action the right to call a veterinarian or to furnish other advisable attention within discretion is granted to Doggone Groomers & Boarding, and any expenses incurred in connection therewith shall be promptly paid by you no later than the designated pick-up date.
Liability. Doggone Groomers & Boarding shall not be liable for any damages to your pet arising out of or from the boarding of your pet or that may accrue from any cause whatsoever in connection therewith, including loss by fire, theft, running away, death, injury, disease or unavoidable causes during the term of this agreement, provided that reasonable diligence and care have been exercised. Owner shall be solely responsible for all acts and behavior of his pet at any time during the term of this agreement. Owner shall indemnify Doggone Groomers & Boarding against all damages sustained or suffered by reason of the boarding of his pet for any claims or injuries whatsoever arising out the the boarding and keeping of his pet. In any event the liability of Doggone Groomers & Boarding shall not exceed the sum of $200.00.
Lien For Charges. Doggone Groomers & Boarding shall have a lien on your pet for all unpaid boarding and other charges resulting from the boarding of your pet pursuant hereto. Owner agrees that in the event the specified boarding charges are not paid within 10 days after they become due and payable, in accordance with the terms hereof, may exercise his lien rights, and in connection therewith, may dispose of your pet for any and all unpaid charges, at private or public sale, after 15 days' notice to owner of such unpaid charges. In the event such sale does not secure a sufficient price to pay the costs of board and other charges, plus costs of sale, owner shall pay to Doggone Groomers & Boarding the difference. Any amounts realized by Doggone Groomers & Boarding at such a sale, over and above charges due and costs of sale, shall be retained by Doggone Groomers & Boarding as liquidated damages for breach of this contract by owner.
Unclaimed Pets. If your pet is not called for within 10 days after declared pick-up date, the pet may be sold either publicly or privately, or authorized at Doggone Groomers & Boarding's descretion anytime after 15 days' notice of such intended sale or authorization, which notice shall be mailed to the owner of the pet at the address given on this contract. Notice shall be deemed given upon mailing. The owner shall have the right to the return of his pet upon payment in full of the outstanding charges within said 15 day period. Owner shall be liable for all charges incurred and an interest rate of 18% per annum will be assessed. If Doggone Groomers & Boarding is required to obtain judgment against owner for any charges due, the owner shall be obligated to pay court costs and reasonable attorney fees.
Claims For Damages. Owner must file with Doggone Groomers & Boarding a written claim for any claimed injury or damages resulting from the boarding of the pet under this agreement as soon as known, but in no event more than 10 days from delivery of the pet to owner pursuant to this agreement or the designated pick-up date, and unless owner files such notice within the prescribed time, he waives any and all rights that he may have against Doggone Groomers & Boarding, for any liablility arising under this contract for damages to his pet.
I have read and understand the terms for boarding my pet and the terms are agreeable to me. It is understood and agreed that the terms of the boarding agreement shall be in effect for all boardings of my pet. |
